- BDSM activity is often used in divorce and child custody cases because it is too often misconstrued as spousal abuse. If you have children at home, make sure you keep a clear line of separation between your BDSM and family lives.
- Remember that the act of a using a dildo could be considered lewd and lascivious in some cities and states.
- Costumes used in BDSM/SM play (especially Military, Police or Fire Officers) could be misconstrued as "impersonating an officer". While in costume, be sure that any holstered weapons are clearly seen as a fake weapons. If you are confronted by a real policeman, and make sure you notify him of the presence of the fake weapon, and make no quick moves.
- Knives and needles could be considered as weapons and needles could be considered as drug paraphernalia in some jurisdictions.
- As a play space owner, you could become a "Guarantor of Public Safety". Be careful what and how you advertise. If your equipment breaks while being used, you could be subject to a civil suit.
- You are not required to answer or open a door unless you are sure as to the identity of someone on the other side of the door. Just remember that the police can enter any building if they feel a persons safety is in jeopardy.
- The sound that a single tail or bull whip makes could sound very much like a gunshot under the right conditions, so let your conscience be your guide.
- You are only required to identify yourself (name, address, etc.)
- Most convictions are a result of information given orally by a detainee. Do not volunteer any information. Clearly state that you do not wish to discuss anything without your attorney being present.
- A Police Officer is required to give you a receipt for anything taken from you.
- Just because an act is consensual, it does not override most laws, such as assault and battery, false imprisonment, etc.
